4th Offense – Forever Barred 5th Offense – Permanent

FELONY DUI §56-5-2945

Great Bodily Injury – “Incarceration” plus 3 years (excludes suspended sentence, probation, and parole)

Death - “Incarceration” plus 5 years (excludes suspended sentence, probation, and parole)

IID is an option for 1st offenses with a refusal or test under .15.

IID is mandatory for 1st offenses with a test .15 or higher.

IID is mandatory for 2nd offenses and higher.
