1. If you are convicted of DUI, you will have a criminal record. This will remain on your record forever and will be used for enhancement purposes for a period of ten (10) years. If you are arrested again within ten (10) years of your first offense conviction, you will be sharged with DUI second offense and so on. The higher the offense, the higher the penalty.

2. The current penalty varies depending upon whether you refused or provided a breath, urine, or blood test. If you provided a sample, penalties are based on the results of that test.

3. The judge may impose a minimum of 48 hours up to 90 days in jail.

4. If convicted, you will have to turn in your drivers license at court and your privilege to drive in South Carolina will be suspended for a period of at least six (6) months.

5. If convicted and you had an alcohol concentration of .15 or higher, you will be required to install an Ignition Interlock Device (IID) in your vehicle. 

6. If convicted, you will be court ordered to enroll in ADSAP (Alcohol Drug Safety Action Program). The approximate cost for ADSAP is $500.00 to $2,500.00.  You may be able to get a provisional license without restrictions during your suspension after enrolling in ADSAP. You cannot apply for the ADSAP program until you are convicted.
